Waging Aggressive War
treaty basis for the crime:
Kellogg-Briand Pact, 1928, Art. I. The High Contracting Parties solemnly declare in the names of their respective peoples that they condemn recourse to war for the solution of international controversies, and renounce it, as an instrument of national policy in their relations with one another. Art. II. The High Contracting Parties agree that the settlement or solution of all disputes or conflicts of whatever nature or of whatever origin they may be, which may arise among them, shall never be sought except by pacific means.
example:
Bush refused to negotiate with the Taliban and Saddam Hussein before launching war.
Aiding Rebels in a Civil War
treaty basis for the crime:
Convention on Duties and Rights of States in the Event of Civil Strife, 1928, Art. 1. To forbid the traffic in arms and war material, except when intended for the Government, while the belligerency of the rebels has not been recognized, in which latter case the rules of neutrality shall be applied.
example:
Bush supported the Northern Alliance, a civil war opponent of the Afghan government in 2001. In Iraq, Bush supported Shiites against Sunnis in 2004-2006 but consistently has opposed the Sadrist faction.
Conspiracy to Wage War
treaty basis for the crime:
Nuremberg Charter, 1945. Crimes against peace: namely, planning, preparation, initiation or waging of a war of aggression, or a war in violation of international treaties, agreements or assurances, or participation in a common plan or conspiracy for the accomplishment of any of the foregoing . . .
example:
American troops entered Afghanistan with the collusion of Uzbekistan. American troops invading Iraq were after collusion with Britain, Kuwait, and Saudi Arabia. Some $700 million was secretly shifted from the war in Afghanistan to the war in Iraq in 2003.
Propaganda for War
treaty basis for the crime:
Civil & Political Rights Covenant, 1966, Art. 20. (1). Any propaganda for war shall be prohibited by law.
example:
Bush issued 259 of his administration's 935 false statements seeking to link Iraq with al-Qaeda or accusing Saddam Hussein of having weapons of mass destruction. In the latter case, he deliberately falsified a CIA report. His onetime press secretary, Scott McLellan, has characterized his misstatements as "propaganda” as has John Stauber's two books–Weapons of Mass Deception: The Uses of Propaganda in Bush's War on Iraq and The Best War Ever: Lies, Damned Lies and the Mess in Iraq.
Use of Depleted Uranium Weapons
treaty basis for the crime:
Radioactive Waste Convention, 1997, Art. 11. Each Contracting Party shall take the appropriate steps to ensure that at all stages of radioactive waste management individuals, society and the environment are adequately protected against radiological and other hazards.
example: Some 2,000 tons of depleted uranium bullets were utilized in the invasion of Iraq.
